Court of Protection

Appoint Us can support someone to access the Court of Protection process in partnership with a solicitor. The Court of Protection is to support and protect those who no longer have capacity to manage their own money and did not put in place a Lasting Power of Attorney.

A person would be referred to the Court Of Protection if they have lost mental capacity and need help accessing and managing their finances. The Court of Protection would appoint a Deputy whose duty it is to ensure their money is looked after and managed appropriately. The Deputy must keep accounts to show how the money is being spent. The Court of Protection oversees this and makes checks on the Deputy appointed.

To ensure that this service is needed a Mental Capacity Assessment would be carried out in the first instance. See our information on Mental Capacity Assessments.
